General Terms, Intended Use and Acceptance

All botanical materials, herbal products, extracts, specimens, and related products offered, referenced, sold, supplied, or distributed through the Website are intended exclusively for lawful non-consumptive applications, including, without limitation, in vitro research and other legally permissible purposes.

No product offered through IndoKratom.ca is approved, intended, marketed, represented, recommended, or sold for human or animal consumption, ingestion, inhalation, topical application, therapeutic use, diagnostic use, veterinary use, medical treatment, clinical application, or any other prohibited purpose.

By accessing, browsing, registering with, purchasing from, or otherwise using IndoKratom.ca, each user and purchaser expressly acknowledges, represents, warrants, and agrees that such access and use are voluntary and are subject to these Terms and Conditions, together with all policies, notices, disclaimers, restrictions, and other terms incorporated herein by reference, as well as all applicable local, municipal, provincial, federal, and international laws, regulations, statutes, and governmental requirements.

Continued access to or use of the Website constitutes acceptance of these Terms and Conditions.

Any person who does not agree to be bound by these Terms and Conditions in their entirety, or who is unwilling or unable to comply with any provision contained herein, is not authorized to access, use, interact with, or purchase from the Website and must immediately discontinue all such activity.

2. Terms of Use

By accessing, browsing, registering with, or purchasing from IndoKratom.ca, the purchaser represents and warrants that they are at least eighteen (18) years of age or have attained the age of majority applicable within their jurisdiction, whichever requirement is greater.

The purchaser further represents and acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions in their entirety, including all incorporated Terms of Use, policies, notices, disclaimers, and restrictions.

Any breach or misuse of the Website or its products or services, unlawful activity, or violation of applicable federal, provincial, municipal, or regulatory requirements may constitute a material breach of these Terms and Conditions and may result in immediate cancellation of pending orders, suspension or termination of accounts, refusal of service, restriction of future purchasing privileges, and the exercise of any other rights or remedies available to IndoKratom.ca at law or in equity.

IndoKratom.ca maintains a strict zero-tolerance policy concerning misuse of its products or services.

Where IndoKratom.ca determines that a purchaser has not attained the applicable age of majority, any pending order may be cancelled, funds received may be refunded where applicable, and the individual may be permanently prohibited from making future purchases.

The purchaser further acknowledges and represents that they possess the legal capacity to understand the nature, scope, and legal effect of these Terms and Conditions.

IndoKratom.ca reserves the right, at any time and where reasonably considered necessary, to request government-issued identification, proof of age, written declarations concerning intended lawful end use, or other relevant documentation before approving an account, processing a payment, accepting a transaction, or fulfilling an order.

Purchasers are encouraged to provide accurate information concerning intended lawful use when requested in order to facilitate account verification, compliance review, and order processing.

Any actual or suspected breach of these Terms and Conditions or applicable legislation or regulatory requirements may result in account suspension, order cancellation and or refusal of service.

3. Product Use Restrictions

All products, materials, information, descriptions, and goods offered through IndoKratom.ca are supplied strictly for lawful non-consumptive purposes, including, without limitation:

herbarium specimens and botanical collections;
educational or scientific analysis and research;
incense making;
candle making;
soap making;
ornamental or archival display; and
other lawful industrial, artistic, analytical, or research applications.

All products are supplied “AS IS” as raw bulk botanical materials, ingredients, or specimens and are provided without instructions for consumption or use, medical claims, therapeutic recommendations, or representations inconsistent with the purposes expressly permitted under these Terms and Conditions.

THE PRODUCTS SOLD BY INDOKRATOM.CA ARE NOT APPROVED, INTENDED, MARKETED, REPRESENTED, RECOMMENDED, OR SOLD FOR INTERNAL OR EXTERNAL HUMAN OR ANIMAL USE, HUMAN OR ANIMAL CONSUMPTION, INGESTION, INHALATION, TOPICAL APPLICATION, MEDICAL OR THERAPEUTIC USE, OR FOR THE DIAGNOSIS, TREATMENT, MITIGATION, PREVENTION, OR CURE OF ANY DISEASE, ILLNESS, AILMENT, OR MEDICAL CONDITION.

Purchasers expressly acknowledge and agree that any use inconsistent with these Terms and Conditions is prohibited and undertaken solely at the purchaser’s own risk.

Nothing communicated or published by IndoKratom.ca, whether through the Website, customer correspondence, social media, advertising or marketing materials, or communications involving its owners, officers, employees, affiliates, contractors, associates, or representatives, shall be interpreted or relied upon as authorizing, recommending, endorsing, encouraging, or permitting the internal or external use of any product contrary to these Terms and Conditions.

Information obtained from third-party or open-source resources, including Wikipedia, Reddit, forums, blogs, social-media platforms, or unofficial publications, does not amend, supplement, override, replace, or supersede these Terms and Conditions.

Such third-party information shall not be treated as authorization for a purchaser to use a product contrary to these Terms and Conditions or applicable laws or regulatory requirements.

Purchasers acknowledge that statements, references, discussions, or publicly available information concerning botanical products sold by IndoKratom.ca have not necessarily been evaluated, reviewed, approved, or verified by Health Canada, the Canadian Food Inspection Agency (“CFIA”), the Food Directorate, the Natural Health Products Directorate (“NHPD”), the Therapeutic Products Directorate (“TPD”), or any other governmental or regulatory authority unless IndoKratom.ca expressly states otherwise in writing.

4. Resale, Redistribution and Prohibited Uses

The resale, redistribution, repackaging, marketing, promotion, supply, or transfer of any product purchased from IndoKratom.ca for purposes associated with human or animal consumption, ingestion, therapeutic application, medicinal use, or any other prohibited purpose is EXPRESSLY FORBIDDEN.

Any actual or suspected violation of this provision may constitute grounds for immediate account suspension or termination, cancellation of pending orders, refusal of future service, restriction of purchasing privileges, and any other action reasonably considered necessary by IndoKratom.ca.

Such conduct may also be subject to applicable federal, provincial, municipal, customs, consumer-protection, food, drug, health, or other legislation within the purchaser’s jurisdiction.

IndoKratom.ca reserves the right, subject to applicable law, to refuse service, cancel accounts, reject orders, and terminate transactions where misuse or prohibited use is reasonably suspected.

5. Product-Related Limitation of Liability

To the fullest extent permitted by applicable law, IndoKratom.ca and its owners, directors, officers, employees, contractors, affiliates, representatives, successors, and assigns shall not be liable for claims, damages, losses, injuries, liabilities, costs, or expenses arising directly or indirectly from the use, misuse, improper handling, improper storage, redistribution, resale, interpretation, reliance upon, or non-use of products, materials, or information supplied through the Website.

Any limitation or exclusion of liability contained herein shall apply only to the maximum extent permitted by applicable law.

All information supplied by IndoKratom.ca, including communications from its owners, officers, employees, representatives, or affiliates, is provided for lawful informational and educational purposes and shall not be construed as encouraging, advocating, advertising, promoting, or advising conduct contrary to these Terms and Conditions or applicable law.

No information obtained from any source shall constitute authorization or justification for misuse of products supplied by IndoKratom.ca.

6. Amendments to Terms

IndoKratom.ca reserves the right to amend, modify, revise, supplement, update, or replace these Terms and Conditions from time to time.

Revised Terms and Conditions shall become effective upon publication on the Website or on such later effective date as may be specified.

Continued use of the Website or placement of subsequent orders following publication of revised Terms and Conditions constitutes acceptance of those revised terms to the extent permitted by applicable law.

RETURN & REFUND POLICY

7. Eligibility for Returns

A product purchased from IndoKratom.ca that remains unopened, unused, untampered with, undamaged, and in its original condition may be eligible for return within fourteen (14) days following the original shipment date, subject to approval by IndoKratom.ca.

All returned merchandise must be received in fully resalable condition and must be free from damage, alteration, contamination, opening, use, or tampering.

IndoKratom.ca reserves the right to inspect returned merchandise and determine whether the applicable return requirements have been satisfied.

8. Store Credit

Subject to applicable law, approved returns shall ordinarily be compensated by store credit equal to the eligible purchase value of the returned product, excluding shipping, handling, processing, return-shipping, or other applicable charges.

Except where otherwise required by applicable law, monetary refunds, cash reimbursements, payment reversals, or charge reversals shall not be provided for approved discretionary returns.

9. Return Shipping

All costs associated with returning merchandise, including shipping charges, duties, insurance, customs charges, and related expenses, shall be the purchaser’s responsibility unless otherwise required by law or expressly agreed to by IndoKratom.ca.

IndoKratom.ca shall not be responsible for shipments that are lost, delayed, damaged, misdirected, or refused while in transit, except to the extent liability cannot lawfully be excluded.

COPYRIGHT

10. Ownership, Copyright, Content, Designs & AI-Generated Materials

All text, graphics, logos, icons, images, photographs, illustrations, advertisements, promotional materials, product images, packaging designs, labels, banners, artwork, audio and video materials, digital downloads, software, code, databases, data compilations, page layouts, designs, written advertising copy, and other materials appearing on, created for, commissioned by, published through, or otherwise made available in connection with IndoKratom.ca (collectively, the “Content”) are owned by IndoKratom.ca.

The Content, including its protectable individual elements and the compilation, selection, coordination, arrangement, modification, and presentation thereof, is protected to the extent applicable by Canadian and international copyright, trademark, trade dress, intellectual-property, contractual, and other proprietary-rights laws.

For greater certainty, the Content includes materials created, developed, modified, enhanced, edited, arranged, composited, or otherwise produced with the assistance of artificial intelligence (“AI”) technologies, generative-AI systems, image-generation software, automated design tools, or other computer-assisted technologies (collectively, “AI-Assisted Content”).

AI-Assisted Content includes, without limitation, product advertisements, promotional graphics, banners, website imagery, product presentations, labels, packaging artwork, logos, marketing materials, social-media graphics, photographic compositions, illustrations, backgrounds, page layouts, typography, written advertising copy, and other visual, written, graphic, or multimedia materials created for, commissioned by, modified for, or used in connection with IndoKratom.ca.

To the extent that any copyright, trademark, trade dress, contractual, proprietary, database, or other intellectual-property or related rights subsist in AI-Assisted Content, including rights arising from human authorship, creative direction, selection, arrangement, coordination, modification, editing, compositing, typography, layout, branding, compilation, or other protectable contributions, all such rights owned by IndoKratom.ca are expressly reserved.

The use of AI, generative-AI technology, automated software, or other computer-assisted technology in the creation, development, modification, or production of Content shall not constitute, whether expressly or by implication, authorization, consent, permission, or a licence for any third party to copy, reproduce, download, extract, scrape, modify, republish, redistribute, imitate, adapt, display, transmit, commercially exploit, or create derivative materials from such Content where doing so would infringe or otherwise violate IndoKratom.ca’s applicable intellectual-property, contractual, or proprietary rights.

Except where expressly authorized in writing by IndoKratom.ca or otherwise permitted by applicable law, no person or entity may reproduce, republish, distribute, sell, license, sublicense, commercially exploit, or otherwise use IndoKratom.ca Content, including AI-Assisted Content, in connection with commercial advertising, competing products or services, product listings, websites, social-media marketing, promotional campaigns, packaging, branding, merchandising, or other commercial activities.

Without limiting the foregoing, and except where authorized by IndoKratom.ca or permitted by applicable law, IndoKratom.ca content shall not be systematically scraped, harvested, extracted, compiled, or reproduced for incorporation into training datasets, machine-learning datasets, generative-AI training systems, model-development datasets, image-generation systems, automated content-generation systems, or similar technological applications where such activity would violate IndoKratom.ca’s applicable rights.

No person or entity is authorized to remove, obscure, alter, delete, crop out, conceal, disable, or circumvent any copyright notice, trademark, trade name, logo, branding element, proprietary marking, watermark, disclaimer, attribution, metadata identifying ownership, or other rights-management information appearing in or associated with IndoKratom.ca Content where such conduct is prohibited by applicable law.

Nothing contained on IndoKratom.ca or in these Terms and Conditions shall be construed as granting, whether expressly, by implication, estoppel, waiver, or otherwise, any third party any licence, ownership interest, authorization, title, or other right in IndoKratom.ca’s trademarks, logos, trade names, branding, original Content, AI-Assisted Content, or other protected intellectual property, except where expressly granted in writing by IndoKratom.ca.

The fact that AI or another automated or computer-assisted technology was utilized in creating, modifying, enhancing, or producing Content shall not, by itself, constitute a waiver, abandonment, dedication to the public domain, or relinquishment of any intellectual-property, contractual, trademark, trade dress, compilation, proprietary, or other rights that IndoKratom.ca may possess in the resulting Content or any protectable component thereof.

Where an individual AI-generated element is not independently eligible for copyright or other intellectual-property protection under applicable law, nothing contained herein shall be construed as asserting a right that does not legally exist. The absence or limitation of protection in any individual AI-generated element shall not constitute a waiver, abandonment, or limitation of any rights that may subsist in the overall work, human-authored portions, creative selection or arrangement, modifications, editing, compositing, compilation, typography, branding, trademarks, logos, trade dress, packaging, advertising campaign, or other independently protectable elements of the Content.

All rights not expressly granted under these Terms and Conditions are reserved by IndoKratom.ca and, where applicable, its licensors and other respective rights holders.

11. Limited Licence

Subject to these Terms and Conditions, IndoKratom.ca grants users a limited, revocable, non-exclusive, and non-transferable licence to access, display, download, and print reasonable portions of the Content solely for lawful personal and non-commercial purposes or for the limited purpose of conducting a transaction with IndoKratom.ca.

This limited authorization does not transfer to the user any ownership, title, intellectual-property right, or other proprietary interest in the Content.

12. Prohibited Use of Content

Except with prior written authorization from IndoKratom.ca, users shall not copy, reproduce, modify, republish, upload, post, transmit, distribute, license, sublicense, mirror, frame, commercially display, sell, exploit, reverse engineer, or create derivative works from the Website or its Content where such activity would infringe applicable intellectual-property rights.

Users shall not remove, obscure, alter, modify, or delete copyright notices, trademarks, proprietary markings, disclaimers, digital watermarks, or other ownership identifiers contained in or associated with Content obtained from the Website.

Unauthorized use may result in termination of access and any civil, equitable, or other remedies available under applicable law.

TRADEMARKS

13. Proprietary Marks

All trademarks, service marks, trade names, business names, logos, domain names, brand identifiers, product names, slogans, trade dress, graphics, packaging elements, designs, and related proprietary materials appearing on or in connection with IndoKratom.ca (collectively, the “Marks”) are owned by IndoKratom.ca.

IndoKratom.ca reserves all rights and remedies available at law or in equity in connection with unauthorized use or infringement of its intellectual-property rights, including, where legally available, injunctive relief, damages, costs, and other appropriate remedies.

WARRANTY DISCLAIMER

14. Website Provided “As Is”

The Website and all Content, materials, information, products, services, functionality, and related resources made available through IndoKratom.ca are provided on an “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS” basis.

To the fullest extent permitted by applicable law, IndoKratom.ca disclaims warranties, representations, guarantees, and conditions, whether express, implied, statutory, collateral, or otherwise, including warranties or conditions relating to merchantability, merchantable quality, fitness for a particular purpose, durability, title, compatibility, security, accuracy, non-infringement, uninterrupted availability, and system integration.

Nothing contained herein excludes any warranty, condition, remedy, or statutory right that cannot lawfully be excluded or limited.

15. Website Availability and Security

IndoKratom.ca does not warrant that the Website, its functions, services, servers, communications, or Content will at all times be uninterrupted, timely, secure, accurate, reliable, or error-free.

Nor does IndoKratom.ca warrant that every defect, inaccuracy, or omission will be corrected or that servers, downloads, communications, or Website functionality will necessarily be free from viruses, malware, malicious code, harmful components, unauthorized access, or other technological vulnerabilities.

16. Accuracy of Information

IndoKratom.ca does not warrant the completeness, accuracy, adequacy, usefulness, reliability, suitability, timeliness, availability, or applicability of every item of information, product description, graphic, statement, or other Content appearing on or accessible through the Website.

Users acknowledge that reliance upon Website information is undertaken at their own discretion and risk, subject to any rights or protections that cannot lawfully be waived.

Certain jurisdictions may prohibit or restrict the exclusion of particular warranties, conditions, or statutory rights. Where such restrictions apply, these provisions shall operate only to the maximum extent permitted by applicable law.

LIMITATION OF LIABILITY

This limitation is intended to apply regardless of whether a claim is advanced in contract, tort, negligence, statute, equity, or another cause of action, but only to the extent permitted by applicable law.

Such excluded losses may include lost profits, lost revenue, lost business opportunities, loss of data, business interruption, reputational harm, costs associated with procuring substitute products or services, and other economic or consequential losses.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

Where applicable law does not permit a particular exclusion or limitation, the relevant exclusion or limitation shall be interpreted and applied only to the maximum extent legally permissible.

TYPOGRAPHICAL AND INFORMATIONAL ERRORS

18. Pricing and Publication Errors

If a product, service, promotional offer, shipping charge, or other information appearing on IndoKratom.ca contains an incorrect price or inaccurate information because of a typographical error, technical malfunction, system error, pricing discrepancy, human error, unauthorized alteration, or similar circumstance, IndoKratom.ca reserves the right, subject to applicable law, to correct the error and to refuse, reject, limit, modify, or cancel an affected order.

An order submission, automated order acknowledgement, or payment receipt shall not, by itself, constitute final acceptance of an order where the Website expressly provides that submitted orders remain subject to verification and acceptance.

Where IndoKratom.ca cancels an order after receiving payment because of a pricing or informational error, any reimbursement, reversal, refund, or store credit shall be handled in accordance with applicable law and IndoKratom.ca’s applicable policies.

TERMINATION

19. Effective Date and Termination of Access

These Terms and Conditions become applicable to users upon accessing, browsing, using, registering with, or otherwise interacting with IndoKratom.ca, including participation in account registration, shopping, ordering, or purchasing processes.

IndoKratom.ca reserves the right, subject to applicable law, to suspend, restrict, terminate, revoke, or discontinue a user account, access privilege, service, product offering, transaction, or Website functionality where permitted by these Terms and Conditions.

Termination or suspension shall not affect provisions which, by their nature, are intended to survive termination, including provisions concerning intellectual-property rights, disclaimers, limitations of liability, governing law, dispute resolution, enforcement rights, accrued obligations, and other provisions intended to have continuing effect.

IndoKratom.ca may provide notices, disclosures, communications, updates, legal notifications, or other correspondence by electronic mail, Website publication, account notification, or another commercially reasonable or legally recognized method using contact information supplied by the user.

Users are responsible for maintaining accurate and current contact information and for reviewing notices made available through the Website.

The legal effectiveness of any notice shall be determined in accordance with these Terms and Conditions and applicable law.

MISCELLANEOUS

21. Governing Law

These Terms and Conditions, use of IndoKratom.ca, transactions conducted through the Website, and disputes or claims arising therefrom shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, subject to any mandatory laws or jurisdictional requirements that cannot lawfully be excluded.

To the extent legally permissible, the parties exclude application of the United Nations Convention on Contracts for the International Sale of Goods (1980).

22. Jurisdiction

To the extent permitted by applicable law, users agree that proceedings arising from or relating to the Website, these Terms and Conditions, or transactions conducted through IndoKratom.ca shall be brought before a court of competent jurisdiction in Winnipeg, Manitoba, Canada.

Nothing herein shall deprive a consumer of any mandatory jurisdictional protection that cannot legally be waived.

23. Limitation Period

Any contractual limitation period stated in these Terms and Conditions is intended to apply only to the extent permitted by applicable law and shall not shorten or eliminate any mandatory statutory limitation period that cannot legally be varied by agreement.

24. No Waiver

No failure, delay, omission, or partial exercise by IndoKratom.ca in enforcing a right, remedy, power, or provision of these Terms and Conditions shall constitute a waiver of that right or remedy.

Any waiver by IndoKratom.ca must be expressly made in writing by an authorized representative to be effective.

No course of dealing, prior conduct, industry custom, trade practice, oral statement, or pattern of performance shall modify these Terms and Conditions except where IndoKratom.ca expressly agrees to such modification in writing.

25. Assignment

Subject to applicable law, IndoKratom.ca may assign, transfer, delegate, subcontract, or otherwise convey its rights or obligations under these Terms and Conditions to an affiliate, successor, purchaser, service provider, or other third party.

Users may not assign their contractual rights or obligations without the prior written consent of IndoKratom.ca except where applicable law provides otherwise.

USE OF SITE

26. Prohibited Conduct

Harassment, abuse, intimidation, threats, discriminatory conduct, or other inappropriate behaviour occurring through or in connection with IndoKratom.ca is prohibited.

This includes communications transmitted through email, live chat, messaging systems, social media, reviews, comments, submissions, or other methods of interaction.

Obscene, profane, defamatory, hateful, abusive, harassing, vulgar, fraudulent, deliberately misleading, threatening, or otherwise unlawful communications or conduct may constitute a material violation of these Terms and Conditions and may result in suspension or termination of accounts, transactions, orders, communications, or services.

27. Impersonation

Users shall not impersonate or falsely represent another individual or entity, including IndoKratom.ca or its owners, officers, employees, contractors, affiliates, representatives, licensors, agents, hosts, moderators, customers, or other persons or organizations.

Users shall not falsely represent or imply an affiliation, endorsement, sponsorship, authorization, or association with IndoKratom.ca or another party.

28. Prohibited Content

Users shall not knowingly upload, post, transmit, distribute, publish, store, or otherwise make available through Website functionality content that is unlawful, fraudulent, defamatory, obscene, threatening, harassing, abusive, invasive of legally protected privacy or publicity rights, discriminatory, hateful, infringing, or otherwise unlawful.

This prohibition includes content that unlawfully encourages or facilitates criminal conduct, fraud, harassment, infringement of intellectual-property rights, privacy violations, or other unlawful activity.

29. Commercial Solicitation

Users shall not use Website functionality to disseminate unauthorized spam, chain letters, mass solicitations, promotional materials, investment schemes, or third-party commercial advertising.

The Website shall not be used to solicit, recruit, advertise, or promote an unrelated competing business, commercial enterprise, organization, or third-party activity without prior written authorization from IndoKratom.ca.

30. Enforcement

Accordingly, to the extent permitted by applicable law, IndoKratom.ca does not assume responsibility for opinions, statements, representations, or activities independently generated by users or third parties.

The availability of forums, communications systems, review functionality, comment sections, or other interactive features does not constitute IndoKratom.ca’s endorsement or verification of user-generated Content.

32. Moderation Rights

Subject to applicable law, IndoKratom.ca reserves the right, but does not undertake a general obligation, to investigate, restrict, refuse, block, edit, remove, or disable access to communications, submissions, accounts, or Content reasonably believed to be:

(c) infringing upon copyright, trademark, trade-secret, patent, privacy, publicity, intellectual-property, or other legally protected rights; or

(d) otherwise unlawful, harmful, inappropriate, or contrary to these Terms and Conditions.

IndoKratom.ca further reserves the right, subject to applicable law, to suspend or terminate accounts, cancel orders, deny access to services, cooperate with competent authorities, and pursue available legal or equitable remedies concerning actual or suspected violations of these Terms and Conditions.

All orders submitted through IndoKratom.ca initially constitute requests to purchase.

An order shall not be considered confirmed or accepted solely because it has been submitted through the Website.

Orders proceed to processing following receipt and verification of payment and remain subject to IndoKratom.ca’s applicable acceptance, verification, compliance, cancellation, and processing policies.

DELIVERY DEFINITION

34. Shipping and Delivery Cut-Off Times

The daily cut-off time for Canadian shipping is 12:00 p.m. CST.

The daily cut-off time for local Winnipeg delivery is 3:00 p.m. CST, Monday through Saturday.

Local delivery is ordinarily available Monday through Saturday, unless otherwise advertised or communicated.

35. Processing Time

INDOKRATOM.CA DOES NOT GUARANTEE SAME-DAY DELIVERY.

IndoKratom.ca requires up to twenty-four (24) hours to process an order.

Orders and payments remain subject to cancellation in accordance with these Terms and Conditions and applicable law.

36. Local Courier Delivery

Local courier delivery is available within the immediate Winnipeg area, generally extending to the Winnipeg Perimeter Highway/Bypass.

For security reasons, local couriers do not enter apartment buildings, office buildings, or other buildings to complete delivery. Customers are responsible for meeting the courier outside the applicable building or at the designated delivery location to receive their package.

37. Rural Courier Delivery

IndoKratom.ca may use rural courier services for eligible destinations immediately outside Winnipeg, including locations such as St. Norbert and other areas generally situated within approximately five (5) to ten (10) minutes outside the Perimeter.

Delivery availability, timing, service area, and courier selection remain subject to operational availability.

products stored under environmentally controlled conditions intended to preserve freshness and product integrity.

39. General Laboratory Testing

The following describes categories of testing that kratom botanical materials may undergo when laboratory testing is performed.

Testing methods, panels, laboratories, standards, detection limits, and testing frequency may vary depending upon the product, batch, supplier, laboratory, and applicable testing requirements.

40. Identification of Botanical Compounds

High-Performance Liquid Chromatography (HPLC)

HPLC testing may be utilized to analyze botanical material, compare compounds or constituents against applicable reference standards, and assist in confirming the identity or composition of a tested sample.

Gas Chromatography-Mass Spectrometry (GC-MS)

GC-MS testing may be utilized for analytical identification and characterization of compounds contained within a tested sample.

Thin-Layer Chromatography (TLC)

TLC testing may be utilized as an analytical method for comparing the botanical or chemical characteristics of a sample against an applicable reference standard.

41. Organoleptic Testing

Organoleptic evaluation may include examination of characteristics such as:

visual appearance;
aroma; and
colour.

Samples may be compared against applicable reference characteristics or standards for the botanical material being examined.

42. Microbiological Testing

Microbiological testing may include:

Total Aerobic Plate Count / Yeast and Mold Count

Such testing may be performed to detect and quantify microorganisms present within a tested sample.

Coliform / E. coli / Salmonella Testing

Testing may also be conducted for the presence or concentration of specified microorganisms or pathogens, including coliform bacteria, Escherichia coli (E. coli), and Salmonella.

43. Heavy-Metal Testing

Where heavy-metal testing is performed, analyzed substances may include:

Inorganic Arsenic;
Inorganic Mercury;

Ruthenium;

Any reference to a “PASS” result shall mean only that the tested sample satisfied the applicable laboratory acceptance criteria or limits identified in the corresponding laboratory report.

44. Pesticide Testing

Where pesticide testing is conducted, samples may be analyzed against the pesticide criteria, testing standards, or certification requirements applicable to the particular product or testing program.

No statement concerning pesticide testing shall, by itself, constitute a representation that a product is certified organic unless the product has actually received the applicable certification and IndoKratom.ca expressly identifies it as such.

MEASUREMENTS

45. Powder Product Weight

Unless expressly stated otherwise on the applicable product listing, packaging, invoice, or other written product information, any powder-product weight described by IndoKratom.ca as a gross measurement means the combined weight of the product and its packaging.

Where a product is represented by net weight, the stated net weight refers to the product weight exclusive of packaging.

46. Severability

If any provision of these Terms and Conditions is determined by a court or other authority of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall, to the extent permitted by law, be severed, restricted, or interpreted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

47. Entire Agreement

These Terms and Conditions, together with all policies, notices, disclaimers, order terms, and other provisions expressly incorporated by reference, constitute the agreement governing use of IndoKratom.ca and transactions conducted through the Website, subject to any rights or obligations imposed by applicable law that cannot legally be excluded or modified.
